Krishnayan Sen

Krish is an accomplished disputes lawyer with over 18 years of extensive experience in corporate-commercial litigation, commercial arbitration, and insolvency litigation. 

He graduated from the National University of Juridical Sciences (NUJS), Kolkata, in 2006, where he distinguished himself by receiving the prestigious Nani Palkhivala Memorial Medal in 2004 and the G. Venkatasubramaniam Gold Medal in 2005.

Throughout his career, Krish has served as a trusted adviser to a diverse clientele, including multinational corporations, large Indian firms, public sector undertakings, statutory authorities, and emerging companies. His versatility as a litigator is evident in his representation of clients across various courts and tribunals, particularly in complex cross-border commercial disputes. Notably, he has appeared in several landmark cases before the Supreme Court of India, including a notable case representing a secured creditor against Kingfisher Airlines, which garnered the Deal of the Year (Disputes) award from the India Business Law Journal.

Qualified as an Advocate-on-Record at the Supreme Court of India, Krish has also served as the Advocate-on-Record for the State of Odisha. Currently, he is a member of the YSIAC Council at the Singapore International Arbitration Centre (SIAC) and has previously held partnership positions at Luthra and Luthra Law Offices and Verus, Advocates. In addition to his legal practice, Krish is an active contributor to leading international journals and frequently shares his expertise as a thought leader at international law conferences, with principal areas of practice encompassing commercial litigation and arbitration, insolvency litigation, intellectual property disputes, and constitutional litigation. Fluent in English, Hindi, and Bengali, Krish continues to make significant contributions to the legal field.

Representative Experience

 Secured creditor

Successfully represented  at the Supreme Court of India against Kingfisher Airlines for recovery of INR 400 crores (Awarded Deal of the Year (Disputes) by India Business law Journal 2015).

 American Tower Corporation

Successfully acted in arbitration proceedings against Sistema Smart Technologies Limited for recovery of its dues in excess of INR 250 crores.

Kotak Mahindra Bank 

Successfully represented in landmark decision setting out secured creditors’ rights to take action against lessees under the Securitization Act, 2002 reported in (2014) 6 SCC 1.

Schlumberger Asia Services Limited 

Acted in an international commercial arbitration against Oil India Limited for its claims arising under a contract for directional drilling and allied services.

Sagar Cements Limited

Successfully represented in a joint venture dispute with their JV partner Vicat Group, France, involving more than INR 500 crores.

McDonald’s

Successfully acted and advised in contentious matters concerning its customer invoicing practices before the Supreme Court and national Tribunal.
